Ex-nursing home COO gets nearly 5 years for kickback schemes

INDIANAPOLIS (AP) — A former top executive of a company that operates dozens of Indiana nursing homes has been sentenced to nearly five years in prison for his role in kickback schemes involving $19 million.

U.S. District Judge Tanya Walton Pratt sentenced 54-year-old Daniel Benson of Fishers to 57 months after he pleaded guilty to money laundering and conspiracy to commit fraud and to violate health care anti-kickback laws.

Benson was chief operating officer of American Senior Communities, which operates about 70 nursing homes. The company’s former CEO, James Burkhart, was sentenced June 29 to nearly 10 years for his role in the schemes that operated from January 2009 to September 2015.

Benson was released and will be instructed when and where to report for his sentence by the U.S. Bureau of Prisons.
