INDIANAPOLIS (AP) — The former CEO of a network of senior living facilities in Indiana could face up to 12 years in prison for a $20 million kickback scheme that defrauded health care organizations throughout the state.

James Burkhart is the former CEO of American Senior Communities, which provides health care and housing to seniors around Indiana. The Indianapolis Star reports Burkhart and three others defrauded Medicare, Medicaid and other health care organizations by creating 20 shell companies.

The four used the stolen money on lavish vacation homes, private planes and diamond jewelry. The men will plead guilty, but Burkhart’s attorney says a 12 year sentence is unfair and is asking the court for less time.

Burkhart will appear in court next Friday.
