Judge dismisses Fort Wayne’s lawsuit over fire protection taxes

FORT WAYNE, Ind. (WOWO): A lawsuit filed by the City of Fort Wayne against the Southwest Allen County Fire District and Allen County Auditor Tera Klutz has been dismissed.

The city filed the lawsuit last May, claiming its fire fund hadn’t received tax distributions for services the city’s Fire Department provided between 1987 and 2006. The city also blamed Klutz, saying an error on her part caused them to miss out on an unspecified amount of money, although Klutz claims she made no such mistakes.

Allen Superior Court Judge Craig Bobay approved a motion filed by both Klutz and the Fire District to dismiss the case, ruling that the court lacks jurisdiction on the matter, and charging the City for court costs.

City spokesman John Perlich provided the following comment:

We have great respect for Judge Bobay and acknowledge that this was a difficult issue. The Court’s decision doesn’t address the essential question of whether the City of Fort Wayne is entitled to property tax revenues from those areas formerly within the Southwest Allen County Fire Protection District that are now within the City and primarily served by the Fort Wayne Fire Department. The decision only says that the Department of Local Government Finance (DLGF) and, ultimately, the Indiana Tax Court are the ones to decide the question. We have 30 days to file an appeal of the jurisdictional issue with the Indiana Court of Appeals, and we have the option of filing for an administrative review with the DLGF. We are currently reviewing those options.
