INDIANAPOLIS _ (NETWORK INDIANA) State Police are investigating a reported rape at the Marion County Jail.

Marion County Chief Deputy Eva Talley-Sanders says the incident happened in Jail 1 at 5:00pm on Wednesday, July 24th. The female inmate claims she was raped, but the male says the sex was consensual.

Talley-Sanders says a deputy returned a male inmate to the jail from court and placed him in a cell block, but the deputy was unaware that a female inmate had previously been moved to the same cell block. The male inmate asked the deputy for a pen, left the inmate for about 4 minutes, and came back to find the woman claiming she had been raped.</span>

Talley-Sanders says inmates are often moved around the jail due to overcrowding issues and a mistake was made placing the female inmate in that particular cell block. Talley-Sanders, and Sheriff John Layton, say overcrowding played a factor, but the jail‘s capacity on that day was actually 90 under capacity. Talley-Sanders says there is no video of the alleged incident. The deputies involved remain on duty, but Talley-Sanders says they will likely face disciplinary action.
