Special Prosecutor Sought in Case Involving Judge

MUNCIE, Ind. (AP) _ A central Indiana prosecutor is seeking a special prosecutor to hear allegations that a Muncie city court judge intimidated another woman during a confrontation outside that woman's home.

Delaware County Prosecutor Jeffrey Arnold tells The Star Press that “it's probably not a good idea'' for one of his staff members to make a decision in the allegations against City Court Judge Dianna Bennington.

Muncie resident Angela Smith recently filed a police report accusing Bennington of intimidation. Smith is the longtime girlfriend of Delaware County Chief Deputy Sheriff Jason Walker, who's the father of Bennington's 16-month-old twins.

Smith says Bennington angrily confronted her outside Walker's home on Sept. 21.

Bennington had previously sought an emergency protective order against Smith, saying Smith and another woman had conspired to follow and harass her.
