Southern Indiana Town Marshal Convicted on 2 Counts

COLUMBUS, Ind. (AP): A jury has convicted a southern Indiana town marshal of felony misconduct and misdemeanor false informing.

The Bartholomew Circuit Court jury deliberated three hours Wednesday before finding suspended Hope Marshal Donald R. “Randy'' Bailey guilty in a case involving the wrongful arrest of a man on intimidation and criminal trespassing charges in May 2012.

Several witnesses testified Bailey told other officers that the man had threatened him and fled when told he was under arrest. However, an audio recording later undermined Bailey's version of events.

Defense attorney Tom Barr says he's disappointed by the verdicts. He says a decision on whether to appeal hasn't been made yet.

Bailey will remain free on bond until his March 24 sentencing.

Hope is about 40 miles south of Indianapolis.
