South Bend Grand Jury Returns Indictment for 6 Involved in Heroin Takedown

SOUTH BEND, Ind. (WOWO): A grand jury in South Bend handed down multiple Indictments Thursday afternoon, against the following:


Eduardo Martinez, age 29, Fort Wayne, IN

Gisela Leyva Gamez, age 28, Phoenix, AZ

Rigoberto Martinez, age 32, Fort Wayne, IN

Cesar Rosales, a/k/a Cesar Raul Rosales Villacenor, age 40, Wilmington, CA

Juan Rosales Suarez, age 41, Memphis, TN

Alejandro Delacruz, age 29, Fort Wayne, IN


The charges were the result of what authorities are calling the largest heroin takedown ever in the Northern District of Indiana.

According to a press release issued in December 2014 by officials with the United States Attorney’s Office, the investigation was based on court-ordered wiretaps of two cellphones used by Eduardo Martinez. In an intercepted call on December 14th, authorities learned that Eduardo Martinez was negotiating with Gamez to arrange for a delivery of heroin to Fort Wayne. The delivery took place on Wednesday, December 17th in the garage at a residence on W. Butler Street. The delivery was made in a pickup driven by Rosales and Suarez.

Law enforcement had the area under surveillance before they moved in and arrested Rosales and Suarez on the premises. Eduardo Martinez and Gamez were arrested a short distance away after trying to flee the scene. Rigoberto Martinez was arrested at the house on W. Butler, where about 3.5 kilograms of heroin were seized in the garage.

United States Attorney David Capp stated, “This is the largest heroin takedown ever in the Northern District of Indiana. These arrests dismantle an organization responsible for bringing large quantities of heroin to the streets of greater Fort Wayne. These arrests and seizures were the result of a great cooperative law enforcement by federal, state and locals.”

Law enforcement located an additional 4.5 kilograms of heroin in the spare tire of the pickup and a search performed at the home of Eduardo Martinez on West State Boulevard also revealed more drugs and guns.  The charges include: 


Eduardo Martinez 

– Conspiracy to distribute and possess with intent to distribute heroin from on or about November 20, 2014, and continuing to on or about December 17, 2014
– Possession with intent to distribute heroin on or about December 17, 2014; maintaining a drug involved premises from on or about July 10, 2013, and continuing to on or about December 17, 2014
– Distribution of methamphetamine on or about September 27, 2013; December 16, 2013; February 10, 2014, and May 28, 2014 
– Being an illegal alien in possession of a firearm on or about December 17, 2014. Defendants


Gisela Leyva-Gamez, Juan Rosales-Suarez, and Cesar Rosales 


– Two counts with conspiracy to distribute and possess with intent to distribute heroin from on or about November 20, 2014

– Continuing to on or about December 17, 2014, and possession with intent to distribute heroin on or about December 17, 2014. 


Rigoberto Martinez 

– Three counts with conspiracy to distribute and possess with intent to distribute heroin from on or about November 20, 2014, and continuing to on or about December 17, 2014
– Possession with intent to distribute heroin on or about December 17, 2014, 
– Maintaining a drug involved premises from on or about July 10, 2013, and continuing to on or about December 17, 2014. 

Alejandro Delacruz 

– Two counts with maintaining a drug involved premises from on or about July 10, 2013, and continuing to on or about December 17, 2014
– Distribution of methamphetamine on or about February 10, 2014.
