S. Indiana Mayor Revokes Asphalt Plant’s Permit

JEFFERSONVILLE, Ind. (AP): The mayor of a southern Indiana city has revoked a zoning permit for an asphalt plant that's being sued by nearby residents over its fumes and emissions.



Jeffersonville Mayor Mike Moore says he gave the order to revoke MAC Construction & Excavating Inc.'s asphalt plant permit on the advice of counsel. Jeffersonville City Attorney Les Merkley tells The Courier-Journal, the permit revocation was related to pending litigation.



Nearby residents sued the city and MAC in 2010, alleging the plant's zoning was approved outside of normal procedures and it produces irritating fumes.



MAC General Counsel Bryan Wickens says that lawsuit is scheduled to go to trial Dec. 2 in Clark Superior Court.

He says MAC will decide how to proceed on the revoked permit based on that litigation's outcome.
