Ruling: City may be liable in former officer’s rape lawsuit

FORT WAYNE, Ind. (WOWO): The Indiana Supreme Court says the City of Fort Wayne may be held liable for damages in a lawsuit against a former city police officer.

The state’s high court passed down the ruling, according to the Journal Gazette, related to the lawsuit against 50-year-old Mark Rogers. He pled guilty to raping a woman in September 2013 in a park, after he found her drunk behind the wheel of her parked car, and was sentenced to six years in prison.

The woman sued three years ago, accusing the city of negligence and saying the City, as his supervisor, is liable for his actions.

The City argued otherwise, saying what Rogers did came outside the “scope of his employment,” but the Court disagreed.
