“Road Rage” attacker to be released

FORT WAYNE, Ind. (WOWO): A Fort Wayne man who was sentenced to a year in prison last week over a road rage incident will be released today.

Last Friday, a jury found 28-year-old Brandon Cook guilty of misdemeanor battery but not guilty of involuntary manslaughter in the August 2018 incident that led to the death of a 60-year-old man.

Police say Cook pulled his vehicle over on US 30 near Goshen Road, walked over to Orlando Fernandez’s car, and punched him repeatedly. The Allen County Coroner reports the attack prompted a fatal heart attack, and Fernandez’s death was ruled a homicide.

With the misdemeanor conviction Cook was sentenced to a year in prison, but he will be credited for time served and released.

The following is a statement from the Allen County Prosecutor’s Office:

Brandon Cook was sentenced this morning to one year, for a misdemeanor battery that he was convicted of by jury last week, in Allen Superior Court. We are proud of the outstanding efforts of law enforcement for their investigation and for locating Mr. Cook so that he could be held accountable for his actions. We are disappointed, on behalf of Mr. Fernandez’s family, with the jury’s verdict finding Cook not guilty of Involuntary Manslaughter. However, we will pursue justice and work on behalf of this community and for families whose loved ones have been victims of crime. We will continue to file and take difficult cases to trial and enforce the laws of the State of Indiana.

I’m in utter disbelief. This is a failure of the Prosecuting office. Residents of Fort Wayne, you deserve better. Write a letter, post a comment. Better yet, vote differently next time.
