Parents Sue Day Care Owner and State in Baby’s Death

NOBLESVILLE, Ind. (AP) – The parents of a 5-month-old boy who died in an unlicensed home day care center in Carmel have filed a lawsuit against its owner and the state Family and Social Services Administration.
 
The Indianapolis Star reports John Tilson Jr. and Britney Killea contend in a lawsuit filed in Hamilton County Superior Court that Conor Tilson died “while sleeping unattended in a hazardous and unsafe environment” that Cox, the FSSA, and the other defendants “knew or reasonably should have known” about. The lawsuit doesn't specify damages.

Cox couldn't be reached for comment because there was no telephone listing for her. A message was left Tuesday by The Associated Press for her defense attorney, Steve Stoesz. FSSA spokeswoman Marni Lemons says the department doesn't comment on pending litigation.
