FORT WAYNE, Ind. (WOWO) – A Fort Wayne man facing trial for murder will be held in contempt of court for spitting on his attorney earlier this week.

Victor M. Rivera III, 21, is accused of fatally shooting Jacob Walerko, 25, last Thanksgiving at a Meijer gas station.

Last month, Rivera was kicked out of the courtroom after he got into an argument with the judge. Then on August 29, he was kicked out again for spitting on his attorney.

Rivera returned to court Friday, August 31, wearing a mask that covered his mouth, according to our partners in news at ABC 21.

The attorney he spit on earlier in the week, William Lebrato, has requested to be removed from the case. Rivera will now be represented by Al Anzini.

In addition to a new attorney, Rivera is being held in contempt of court for spitting on Lebrato, and will be held in jail for six months. This will not count toward his future sentencing.

Rivera’s pre-trial conference is scheduled for September 14.
