LAFAYETTE, Ind. (AP) – A mediator says a federal lawsuit has been settled between the city of Lafayette and a man who was shoved by police officer and sent toppling out of his motorized wheelchair in 2013.
A letter submitted last week to a judge by the mediator says the suit filed by 26-year-old Nicholas Kincade was resolved out of court. WLFI-TV (http://bit.ly/1Fnkd79 ) reports the terms are not yet known.
The (Lafayette) Journal & Courier (http://on.jconline.com/1AevwQc ) reports the judge vacated all upcoming hearings, and Kincade has 30 days to acknowledge consent in dismissing the complaint.
Lafayette Police Lt. Tom Davidson hit Kincade during a confrontation Oct. 1, 2013. Kincade says his constitutional rights and the Americans with Disabilities Act were violated.
Davidson was suspended and demoted to officer, despite a department recommendation that he be fired.
