Judge Won’t Dismiss Charges in Parents’ Deaths

WINCHESTER, Ind. (AP) _ A judge is refusing to dismiss murder charges against an eastern Indiana man who authorities say fatally shot his father and gave his mother a fatal overdose of medication.

The Randolph County judge has also ruled prosecutors could change the charge against 36-year-old Brian Hartman in connection with his mother's death from assisting suicide to murder.

Hartman's defense attorney asked that the charges be dismissed after the Indiana Supreme Court ruled his confession to police was inadmissible. The Star Press reports Hartman's attorney the scheduled September trial delayed.

Prosecutors say Hartman told investigators in early 2010 that he and his parents had “made a plan'' for him to shoot his sleeping 53-year-old father and give his 52-year-old mother a fatal overdose at their rural home outside Winchester.
