Groups want Indiana Justice Off Power Plant Case

INDIANAPOLIS (AP) _ The Sierra Club and three other groups fighting a proposed $2.8 billion coal-gasification plant in southern Indiana want a state Supreme Court justice to withdraw from a case involving the plant.

The groups filed a motion Tuesday asking that Justice Mark Massa be recused or disqualified from the Indiana Gasification case now before the court because he's a longtime friend of Mark Lubbers. They question whether Massa can remain objective because Lubbers represents the Rockport project's developers.

Indiana's high court is to hear oral arguments Sept. 5 over a state contract involving the plant.

Court spokeswoman Kathryn Dolan says Massa cannot comment on the request because judicial rules bar judges from speaking publicly about cases pending before them.

Dolan says Massa doesn't have to respond to the groups' motion.
