Gingerich seeks juvenile status in retrial

WARSAW, Ind. (WOWO):  A 15-year-old boy sentenced to 25 years in prison after pleading guilty three years ago to conspiracy to commit murder in the killing of a friend’s stepfather is set to ask a judge to allow his retrial to be held in juvenile court.

The state appeals court last year threw out the guilty plea and sentence of Paul Gingerich, saying a Kosciusko County judge rushed when he waived the case to adult court.

A hearing on Gingerich’s request seeking juvenile status is scheduled for Monday afternoon in Warsaw.

The case involves the fatal shooting of 49-year-old Phillip Danner in April 2010 at his home near Lake Wawasee.
