Central Indiana Prosecutor Challenging Expungement Law

MARTINSVILLE, Ind. (WOWO): A central Indiana prosecutor is asking a judge to throw out a new state law letting people with low-level criminal convictions have their records wiped clean.
 
       Morgan County Prosecutor Steve Sonnega says he believes the Legislature overstepped its authority by writing the law so that judges have no discretion on whether to grant the expungement.
 
       The law approved by wide bipartisan votes in the Legislature allows old convictions to be sealed if the person has completed their sentence and not been convicted of other crimes for several years.
 <br />        Republican Rep. Jud McMillin of Brookville was a sponsor of the law. He says the law might need fine tuning, but people who have turned their lives around deserve a second chance.
