FORT WAYNE, Ind. (AP) – Lawyers for a suspended Indianapolis police officer charged with reckless homicide and other charges involving his squad car crashing into two motorcycles, killing one and seriously injuring two others, are asking the judge to throw out testimony of a police captain because he read email summaries of the case before testifying.
 
Allen Superior Judge John Surbeck criticized the Indianapolis Metropolitan Police Department on Wednesday after learning a police major had been emailing department leaders daily summaries of Officer David Bisard's trial to five department's leaders. 
 
The Indianapolis Star reports Surbeck said Friday he would consider the request from lawyer John Kautzman to strike the testimony of Capt. Harold Turner and rule on it later, but said it was unlikely he would discard the testimony.
