Passenger in deadly Bishop Dwenger student crash sues driver, bars

FORT WAYNE, Ind. (WOWO): The passenger in a deadly crash has filed a civil tort lawsuit.

Clayton Delong was in the car with Jeremy Washington, who was sentenced to 9 years in prison after being charged in a crash that killed Haley Nullum, 17, a Bishop Dwenger student.

21 Alive reports that Delong is suing driver Jeremy Washington, Brian M. Ybarra (the man Washington allegedly argued with at the bar the night of the crash), Safe Auto Insurance, Snickerz, Peanuts Food & Spirits and Corner Pocket Pub.

Washington was convicted on four of eleven charges, including reckless homicide and criminal recklessness. However he was not convicted on charges of murder and attempted murder after he was accused of fleeing a fight at a local bar and driving while intoxicated.

Delong is seeking damages for hospital costs, lost wages, uninsured benefits and legal costs.

In the tort claim, Delong says Snickers, Peanuts Food & Spirits and Corner Pocket served Jeremy Washington alcohol when he was visibly intoxicated.
