Stores Seek Court’s Help in Cold Beer Ban

INDIANA, (WOWO): Gas stations and convenience stores in some states, including Indiana are turning to the courts in hopes that they might lift a ban on selling cold beer.

For a half a century now, only liquor stores have been allowed to sell cold beer here in the Hoosier state -- grocery and convenience stores can only sell it warm. 

After years of lobbying the General Assembly, a federal lawsuit has now been filed that challenges the constitutionality of such laws.  Attorney John Maley says a lawsuit was not the Convenience Store Association's first choice...

“This association has tired to work to modify law, but the constitution lives on and its time for this to be addressed.”

Maley says Indiana is the only state to restrict beer sales based on temperature.
